General Terms and Conditions of Sale

1. General Provisions and Identification of the Seller

These General Terms and Conditions of Sale (hereinafter “Terms and Conditions”) govern the distance purchase of products sold on the website https://sibania.com/ (hereinafter “Website”).

Products purchased on the Website are sold directly by:

Use of the Website and the submission of a purchase order imply acceptance of these Terms and Conditions by the User/Buyer.

2. Product Characteristics and Artisanal Craftsmanship

All works offered on the Website are sculptures and objects in porcelain, made and hand-painted. The products are standard items available in the Website catalogue: the Customer does not choose or commission a customised item.

Artisanal craftsmanship: as the production is manual, slight differences in appearance (drapery of garments, intensity of colours, arrangement of textures, painting, etc.) are inevitable and are a characteristic of handmade products. Such differences are not considered conformity defects. Substantial differences from the product description on the Website are excluded.

Product images are for illustrative purposes only. The finish or colour shades of the delivered item may differ slightly from the photographs.

3. Prices, Currency and Orders

• All prices shown on the Website are expressed in euros (€) and include VAT and any other applicable taxes.
• Prices do not include shipping costs, which are clearly indicated in the checkout summary before order confirmation.
• For deliveries to non-EU countries, any customs duties, import taxes or local charges are payable by the recipient.
• The order confirmation button reads “Place order with obligation to pay”.
• The sales contract is concluded when the Buyer receives the order confirmation sent by Sibania by email.

4. Payment Methods

Payment may be made by the following methods:

• Credit and debit cards (Visa, Mastercard, American Express)
• PayPal
• Stripe
• Bank transfer (the order is processed only after the transfer has been credited to Sibania’s bank account)

Payments are handled by banking networks or integrated payment gateways, through a secure connection protected by SSL/TLS encryption. Sibania does not store complete payment card details.

5. Processing Times and Shipping

• Processing times: orders are handed over to the courier within 3 working days from receipt of payment (or from the credit, in the case of bank transfer).
• Unavailable items: if an item becomes out of stock after order confirmation, Customer Service will inform the Buyer by email within 3 working days, indicating restocking times. The Buyer may accept the wait or cancel the order with a full refund of the amount paid.
• Maximum delivery time: in any case, delivery takes place within 30 days from order confirmation, unless otherwise agreed with the Buyer.

6. Right of Withdrawal and Returns

The Consumer Buyer has the right to withdraw from the contract, without giving reasons, within 14 days from the date on which they physically receive the product (art. 52 et seq. of the Italian Consumer Code).

Exercising the right of withdrawal:

the Buyer may use the online withdrawal function available on the Website, or send an explicit communication to info@sibania.it, including via the standard withdrawal form.

Return conditions

• the product must be returned within 14 days from the withdrawal notice, in its original packaging. If the product is returned damaged due to inadequate packaging, Sibania may deduct the actual reduction in value, documented with photographs.
• The Buyer is liable only for any decrease in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
• Return shipping costs for withdrawal are borne by the Buyer. The product must be sent to: Via Croce 44-46 – 36033 – Isola Vicentina – Vicenza – Italy. We recommend using a trackable shipping service and keeping the receipt.
• Sibania will refund the amount received, including standard delivery costs, within 14 days from receipt of the returned product or proof of its dispatch, using the same payment method used by the Buyer, unless otherwise expressly agreed.

Damaged or defective products

if the product arrives damaged during transport, the Buyer must report it to Sibania within 14 days from delivery, attaching:

1. clear photographs of the external packaging, showing any visible damage;
2. detailed photographs of the product and of the damage found.

Subject to agreement with Customer Service, the Buyer returns the damaged item in its packaging. Return costs for transport damage are borne by Sibania. Once the item has been received, the Customer may choose between a replacement of the product and a refund of the price, as provided by law.

7. Legal Guarantee of Conformity

All products sold on the Website to consumer customers are covered by the Legal Guarantee of Conformity provided for by articles 128 et seq. of the Italian Consumer Code, for a period of 24 months from delivery.

The Customer who finds a conformity defect must report it to Sibania within 2 months of discovery. The differences arising from handmade craftsmanship described in article 2 remain unaffected.

8. Applicable Law and Competent Court

These Terms and Conditions are governed by Italian law, without prejudice to the application of the mandatory consumer protection rules of the country of the Buyer’s habitual residence.

For disputes with consumers, the Buyer retains the right to bring proceedings before the court of the place where they reside or are domiciled, as provided by European and national legislation on the matter.
